Recently, a Brazilian court ordered the Brazilian Agency for Environmental Protection and Renewable Natural Resources (IBAMA) to re-evaluate the toxicity levels of the active ingredients Thiamethoxam, Clothianidin and Fipronil, and set a deadline.
According to prosecutors, there were indications that the chemicals had a detrimental effect on bees, leading to mass deaths of pollinators. According to 9th Federal Court Judge Clarides Rahmeier's decision, thiamethoxam and clothianidin must be reassessed within 6 months and fipronil within 12 months.
The Federal Prosecutor's Office (MPF) has filed a lawsuit alleging that administrative procedures by the Brazilian Agency for Environmental Protection and Renewable Natural Resources (IBAMA) delayed the completion of the analysis of the active ingredients.
In the judge's view, the procedure was "extremely cumbersome and required cooperative action by various agencies to implement it, which resulted not only in the statutory time limit for such cooperative action, but also in a reasonable and consistent time limit for the completion of the investigation." Even recognizing that "The defendant's institution has encountered technical, physical, functional or material difficulties," and it must also be taken into account that this situation cannot be used as a reason for violating the basic precepts, especially in this case, the principle of a reasonable period of time for procedures, including administrative procedures.
The judge ruled that IBAMA must submit a procedural timetable within 30 days to meet the established deadline.
IBAMA can appeal the decision to the Federal District Court for the Fourth District.
